When a landlord applies for a licence for a HMO, the property is approved for a maximum number of persons. If there are more people living in the property than the license allows, the landlord has committed an offence.

 

You should report any damage or disrepair to your landlord immediately. It's always a good idea to follow up any reports you make over the phone or in person with a letter so both you and your landlord have a record of any work that needs to be done.

It can be difficult to gather up a deposit as well as a month's rent in advance. There are a few places that may agree to provide your landlord with a guarantee or work out a payment plan, allowing you to pay off your deposit in installments.

Private tenants can apply for extra housing benefit if the amount they are getting doesn't cover their rent. This is known as a discretionary housing payment. The Housing Executive decides whether you are entitled to extra benefit and how much you should get.

Talk to your landlord if your tenancy is due to end in the next few months. You could

  • give notice if you want to move out,
  • sign a new contract if you want to stay long-term, or
  • keep renting on a month-to-month basis. 

If your current housing situation doesn't suit your needs it's natural to think you might have to move. But, with the right help and support, you may be able to continue living in your current home. While housing waiting lists are so long and renting privately can be expensive it's worth checking if you can do something practical to allow you to continue living where you are.

The entire deposit for a shared property is normally protected as a lump sum. One tenant will act as the lead tenant. The lead tenant is the only tenant that the deposit company will deal with. 

Your tenancy agreement is a legal contract and you are bound by the agreement until it expires.  If you leave before the contract expires, your landlord can sue you for any outstanding rent. However, the landlord is bound by the contract in the same way that you are.  If you feel the landlord has materially breached the agreement, you can use this argument to defend yourself at court.

Renting a room in a shared house used to be something associated with students or young people. But, this type of renting arrangement is becoming much more common, and many people live in shared housing well past their student years.

A house in multiple occupation, or HMO, is a particular type of rented housing, but not all shared housing will be a HMO. It's important to know if the home you are renting should be classed as a HMO. If it is, it must be licensed and meet extra safety standards.
